Local borderline products: what the combined submission notice changes

Understand the NMRA's new local borderline-product classification and formulation-document submission requirements and transitional arrangements.

Some locally manufactured products need two different regulatory decisions: what category the product belongs to, and whether its formulation meets the applicable requirements. The National Medicines Regulatory Authority (NMRA) has changed the timing of the documents submitted for new local borderline applications. The distinction still matters.

First, determine what needs classification

The NMRA considers a product's intended use, claims, ingredients, active-substance concentrations and other relevant characteristics. A product described as a supplement or herbal preparation is not automatically a borderline product. A preliminary assessment helps prepare the evidence, but the formal decision is issued by the NMRA.

The NMRA's Borderline Products page states that a Classification Report is valid for one year from its approval date, and that only two additional data submissions are allowed for one classification application, each within three months of the relevant report.

What the new local notice requires

For new local applications, the NMRA directs applicants to submit the documentation required for formulation approval, except the Preliminary Evaluation Report (Classification Report), together with the application for classification. The applicable formulation approval fee is also paid when the classification application is submitted to the Borderline Products Regulatory Division; the notice states that applications without the relevant payment will not be accepted for processing.

This is a change to the timing and combination of the submission materials. It should not be interpreted to mean that classification, formulation approval or product registration is granted automatically.

The notice page does not show an effective date, and the Borderline Products page does not yet describe the single-stage application. The NMRA has not yet published how the existing validity periods apply when formulation documents are submitted with the classification application, so applicants should confirm the current position with the NMRA when planning a timetable.

What happens to applications already submitted?

The same notice states that applications for which classification was already submitted continue under the existing procedure. Those applicants submit the formulation approval application separately, together with the Preliminary Evaluation Report (Classification Report).

The application status therefore matters. A company with an existing classification submission should not simply assume that it must restart under the new arrangement.

Imported products follow different steps

The local combined-document notice is addressed to local manufacturers and should not be applied to imported borderline products. The NMRA publishes separate imported-product requirements involving classification, applicable Sample Import Licence steps and product registration.

Prepare complete product information

Applicants should assemble consistent information on the manufacturer, intended use, master and batch formulations, labels, relevant certificates and the available quality documentation. Claims should be reviewed alongside the formulation and intended purpose.

How RAQ can assist

RAQ Consultation can assist with preliminary product assessment, document gap review, classification application preparation and coordination of the applicable next steps. The final classification and regulatory decisions remain with the NMRA.
